Enkept Data Processing Agreement (DPA)

This Data Processing Agreement ("DPA") is entered into between Fastcurve Services Private Limited, Bengaluru, India ("Enkept," "we," "us," or "our") and the customer ("Controller," "you," or "your") using Enkept's services.
This DPA outlines the terms governing the processing of personal data in compliance with the Digital Personal Data Protection Act, 2023 (DPDP Act), India and is designed to align with globally recognized standards where applicable.
- Definitions
- Controller: The entity determining the purposes and means of processing personal data.
- Processor: Enkept, which processes personal data on behalf of the Controller.
- Personal Data: Any information relating to an identified or identifiable natural person.
- Processing: Any operation performed on Personal Data, including collection, storage, use, modification, and deletion.
- Sub-Processor: A third-party engaged by Enkept for data processing activities.
- Scope and Purpose
- Enkept processes Personal Data solely to provide its services, as instructed by the Controller, in compliance with this DPA.
- The categories of Personal Data processed include:
- Name, email, and contact details
- Employment details (designation, employer name)
- Device and usage data
- Location data (where enabled by users)
- Enkept shall not process Personal Data for purposes beyond service delivery unless required by law.
- Data Security
- Enkept implements industry-standard security measures, including:
- Data encryption in transit and at rest
- Access controls and authentication mechanisms
- Periodic security audits and risk assessments
- The Controller shall ensure that users comply with security best practices, including safeguarding login credentials.
- Sub-Processing
- Enkept may engage Sub-Processors for service delivery (e.g., cloud hosting, payment processing). A list of Sub-Processors is available upon request.
- Enkept ensures that Sub-Processors adhere to equivalent data protection obligations.
- Data Transfers
- All data is processed and stored in India.
- If data is transferred outside India, Enkept ensures it meets recognized data protection safeguards.
- Data Subject Rights
- Enkept assists the Controller in responding to requests from individuals regarding:
- Access to their Personal Data
- Correction or deletion of their data
- Restriction or objection to processing
- Requests must be submitted to support@enkept.com.
- Data Retention and Deletion
- Enkept retains Personal Data as long as necessary to fulfill contractual obligations, comply with laws, and prevent fraud.
- Upon termination of services, Enkept deletes or returns all Personal Data unless legal obligations require retention.
- Liability and Indemnification
- Enkept shall not be liable for breaches caused by the Controller’s negligence or third-party actions outside its control.
- The Controller indemnifies Enkept against claims arising from misuse of services or data processing violations.
- Governing Law and Jurisdiction
- This DPA is governed by Indian law.
- Any disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, India.
