Enkept Terms of Use

These Terms of Use ("Terms") govern your access to and use of Enkept, a product of Fastcurve Services Private Limited, Bengaluru, India ("Enkept," "we," "us," or "our"). By using Enkept's services, you agree to comply with these Terms. If you do not agree, you may not use our services.

  1. Acceptance of Terms
    1. By registering, accessing, or using Enkept, you confirm that you have read, understood, and accepted these Terms.
    2. These Terms may be updated from time to time. Continued use of our services constitutes acceptance of the revised Terms.
  2. Eligibility and Account Security
    1. You must be at least 18 years old or allowed by law to use Enkept.
    2. You are responsible for maintaining the security of your account credentials and must not share them with unauthorized individuals.
    3. Any activity under your account is your responsibility. Notify us immediately of any unauthorized use.
  3. Use of Services
    1. Enkept provides HRMS and related services for workforce management.
    2. You agree to use our services lawfully and in accordance with applicable regulations.
    3. Lawful Use: Services must be used in compliance with all applicable laws, including Digital Personal Data Protection Act, 2023 (DPDP Act), India and other relevant regulations.
    4. Authorized Access: Users must access only those features, data, and resources they have been granted permission for.
    5. Data Accuracy: Users must ensure that all data input into the platform is accurate and up to date.
    6. Respect for Others: Users must not engage in harassment, abusive behavior, hate speech, or any form of discrimination using Enkept.
    7. No Harmful Activities: Users must not upload or distribute malicious software, viruses, or engage in activities that disrupt or degrade the performance of the platform.
  4. Prohibited Activities
    1. Prohibited activities include:
      1. Violating any applicable laws or regulations.
      2. Using the platform for fraudulent or malicious activities.
      3. Attempting to interfere with or disrupt Enkept’s services.
      4. Unauthorized Data Access: Attempting to access, modify, or delete data that does not belong to the user without authorization.
      5. Automated Data Scraping: Using automated tools, bots, or scripts to collect or extract data from the platform.
      6. Account Sharing: Sharing login credentials with others or impersonating another user.
      7. Illegal Content: Uploading, sharing, or distributing content that is illegal, defamatory, or violates intellectual property rights.
      8. Excessive API Usage: Overloading Enkept’s systems through excessive API requests that may impact performance.
  5. Data Protection and Privacy
    1. Enkept adheres to the Digital Personal Data Protection Act, 2023 (DPDP Act), India and takes data security seriously.
    2. Your data is collected, stored, and processed in accordance with our Privacy Policy.
    3. Enkept may use aggregated and anonymized data for service improvement and analytics.
    4. User Responsibility: Users must ensure they protect their login credentials and notify Enkept of any unauthorized access.
    5. Confidentiality: Users must respect the confidentiality of any information accessed through the platform.
    6. Data Retention: Users acknowledge that data entered into Enkept will be processed as per Enkept’s Privacy Policy and may be retained or deleted according to legal requirements.
  6. Security & System Integrity
    1. No Reverse Engineering: Users must not attempt to reverse engineer, decompile, or tamper with Enkept’s software or services.
    2. No Network Attacks: Users must not attempt denial-of-service attacks, hacking attempts, or any action that may compromise system security.
    3. Security Breach Reporting: Users must report any discovered vulnerabilities as per Enkept’s Vulnerability Disclosure Policy.
  7. Service Availability and Modifications
    1. We strive for high availability but do not guarantee uninterrupted service.
    2. Enkept may modify, suspend, or discontinue features without prior notice.
    3. We are not liable for service disruptions due to factors beyond our control.
  8. Fees and Payment
    1. Certain Enkept services may require payment as per applicable pricing plans.
    2. Payments are non-refundable unless otherwise stated.
    3. Failure to pay may result in service suspension or termination.
    4. We reserve the right to change pricing with prior notice.
  9. Third-Party Integrations
    1. Enkept integrates with third-party services for enhanced functionality.
    2. We disclaim liability for the security, performance, or reliability of third-party services.
    3. Users should review third-party policies before using integrations.
  10. Termination
    1. Enkept may suspend or terminate your access if you violate these Terms.
    2. You may discontinue using our services at any time.
    3. Upon termination, you must cease using our services, you lose access to all stored data, which may be deleted per our Data Retention Policy.
  11. Limitation of Liability
    1. Enkept is provided "as is" without warranties of any kind.
    2. We are not liable for indirect, incidental, or consequential damages arising from your use of our services.
    3. Our total liability shall not exceed the amount paid by you in the past three months.
  12. Intellectual Property
    1. Enkept and its associated content, trademarks, and intellectual property are owned by Fastcurve Services Private Limited.
    2. You may not copy, modify, distribute, or create derivative works without explicit permission.
  13. Violation Consequences
    1. Warnings: Minor violations may receive a warning.
    2. Account Suspension: Severe or repeated violations may result in temporary suspension.
    3. Termination: Enkept reserves the right to terminate accounts engaging in prohibited activities.
    4. Legal Action: In cases of legal violations, appropriate legal actions may be taken.
  14. Governing Law and Dispute Resolution
    1. These Terms are governed by the laws of India.
    2. Any disputes shall be resolved under the exclusive jurisdiction of courts in Bengaluru, India.
  15. Amendments
    1. We reserve the right to modify these Terms at any time, with updates communicated via our platform.
    2. Your continued use of the services constitutes acceptance of the revised Terms.
